Law of Succession

“Daar wordt een erfenis verdeeld” (they are dividing an inheritance) is a Dutch idiom that means that something takes very long. This is often the case when an estate has to be settled. The main reason is that heirs, related to each other or not, often cannot come to an agreement on the settlement. In this context, issues can arise about the amount of the inheritance, the exigibility, and whether the (money) claim of the heir can be enforced. In addition, discussions can arise between heirs and non-heirs about whether the contents of the (relevant) will really encompasses the ‘will’ of the deceased, what rights a child has to the estate of their parent when they have been disinherited, and whether they can exercise their right to their statutory share. Uncertainties can also arise when it comes to the acceptance of the estate and the (legal) effects of the statutory law of succession (in the absence of a will) for the various heirs.
